These Terms of Service (the “Terms”) govern your access to and use of the website at [tripoutbound.co], the Tripoutbound mobile applications, APIs, and related services (collectively, the “Services”).

The Services are provided by Tripoutbound UG (haftungsbeschränkt) (“Tripoutbound,” “we,” “our,” or “us”), a company incorporated in Germany, HRB 279949 B, Amtsgericht Charlottenburg, with its registered office at Irmtraud-Morgner-Straße 4, 10318 Berlin, Germany.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

We may update, change, or discontinue any aspect of the Services at any time.

4. Subscriptions, Fees, and Payments

  • Certain features are available only through paid subscriptions.

  • Fees are listed in EUR, inclusive or exclusive of VAT as indicated.

  • Subscriptions renew automatically unless cancelled before the renewal date.

  • Payments are processed by third-party providers such as Stripe.

  • You are responsible for providing accurate billing information.

  • Refunds are provided only where required by law.

5. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes or in violation of these Terms.

  • Interfere with or disrupt the security, integrity, or performance of the Services.

  • Attempt to gain unauthorized access to accounts, systems, or networks.

  • Copy, distribute, or reverse engineer any part of the Services.

6. User Content

  • You retain ownership of your content but grant Tripoutbound a worldwide, non-exclusive, royalty-free license to use, display, and distribute it solely to provide the Services.

  • You represent that you have the necessary rights to upload your content and that it does not infringe third-party rights.

  • The Services may integrate or link to third-party services (e.g., airlines, hotels, booking engines).

  • Tripoutbound is not responsible for third-party content, policies, or practices.

  • Your interactions with third-party services are governed by their own terms.

  • The Services, including all software, design, and content, are the property of Tripoutbound or our licensors and are protected by copyright, trademark, and other laws.

  • Except as expressly permitted, you may not copy, modify, or distribute any part of the Services.

  • “Tripoutbound” and related marks are our trademarks and may not be used without our permission.

9. Availability and Maintenance

  • We aim to provide high availability but do not guarantee uninterrupted operation.

  • Services may be suspended for maintenance, updates, or security reasons.

10. Termination

  • We may suspend or terminate your account if you violate these Terms.

  • You may cancel your account at any time.

  • Upon termination, rights and licenses granted to you will end, but provisions relating to intellectual property, liability, indemnification, and governing law will survive.

  • We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.

  • We do not warrant that itineraries or travel data are accurate, complete, or error-free.

12. Limitation of Liability

  • To the maximum extent permitted by law, Tripoutbound is not liable for indirect, incidental, or consequential damages, including loss of profits or data.

  • Our aggregate liability to you for all claims will not exceed the greater of €100 or the amounts you paid us in the 12 months preceding the claim.

  • Nothing in these Terms excludes liability for death, personal injury, or fraud caused by our negligence.

13. Indemnification

You agree to indemnify and hold harmless Tripoutbound, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.

14. Governing Law and Jurisdiction

  • These Terms are governed by German law.

  • Exclusive jurisdiction for disputes lies with the courts of Berlin, Germany.

15. Changes to Terms

  • We may revise these Terms from time to time.

  • Updates will be posted with a “last updated” date.

  • Continued use of the Services after changes constitutes acceptance.
